On Tuesday, May 28th, just before noon, Trooper Steven LaRocco assigned to the Massachusetts State Police Sturbridge Barracks, stopped a black Toyota Corolla on Route 395 North for operating without a front license plate.

After a search of the vehicle, the rear passenger, 25-year-old Eliezer Delvalle of Webster was arrested for illegally possessing a firearm, among other charges.

While conversing with the occupants, Police say the Trooper could smell remnants of burned marijuana and observed a plastic package containing marijuana on Delvalle’s lap and near the front passenger.  “While marijuana has been legalized in Massachusetts consumption and open containers in public areas is not.” the State Police posted on Facebook.

A search of the vehicle turned up 38 Oxycodone pills and a Springfield Armory 9mm semi-automatic firearm with 14 rounds of ammunition in the magazine on Delvalle.  Police say he does not legally possess a Massachusetts license to carry a firearm.

Delvalle was placed under arrest and transported to the Sturbridge Barracks for booking and where bail was set $500.00.  He was arraigned in Dudley District Court.

Delvalle was charged with unlawful carrying a loaded Firearm, possession of a firearm; possession of a large capacity feeding device, possession of ammunition without FID Card and possession of class B substance.  He was also issued a Massachusetts civil citation for an open container of marijuana in a motor vehicle.

The driver and front passenger were identified and released with civil motor vehicle citations but their names were not released.
